Accepting these terms

Variable Software, Inc. ("we," "us" or "our") makes Spray Day (the "App"). By downloading, installing or using the App you accept these terms. If you do not accept them, do not use the App.

The terms of the platform store you installed the App from also apply to your use of the App.

Your license to use the App

We grant you a personal, non-exclusive, non-transferable and revocable license to download, install and use the App for your own non-commercial entertainment, on devices you own or control, as these terms and the platform store's rules permit.

Restrictions on use

You may not:

• copy, modify, distribute, sell or rent the App or any part of it;
• reverse engineer, decompile or disassemble the App, except where the law allows it despite this restriction;
• cheat, or use bots, exploits or unauthorized software that changes how the App works;
• use the App in a way that breaks the law or harms others.

Virtual items

The App has virtual items, such as in-game currency and items you earn or unlock. Virtual items are part of the license we grant you: you do not own them, they have no real-world money value, and they cannot be exchanged for money or for anything of value outside the App, except where the law requires otherwise.

Health and safety

The App is a virtual reality experience. Before you play, read and follow the health and safety warnings of your headset's manufacturer.

• Play in a clear, safe space, away from people, pets, furniture, walls and stairs.
• Take regular breaks. Stop playing at once if you feel dizziness, nausea, eye strain or any other discomfort, and do not play again until it has passed.
• Children may use the App only as the headset manufacturer's age guidance allows, and with adult supervision.

Ownership

The App and its content, including its code, artwork, music, characters and names, belong to Variable Software, Inc. or its licensors and are protected by law. These terms give you no rights in them beyond the license above.

Disclaimers

To the extent the law allows, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the App is free of errors or that it is available at all times.

Limitation of liability

To the extent the law allows, Variable Software, Inc. is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the App, and our total liability for any claim about the App is limited to the amount you paid for the App and its in-app purchases. Some places do not allow these limits, so they may not apply to you.

Termination

You can stop using the App and end these terms at any time by uninstalling the App. We may end your license if you break these terms. When the terms end, you must stop using the App; the sections on ownership, disclaimers, limitation of liability and governing law continue to apply.

Changes to these terms

We may change these terms. When they change, the date at the end of these terms changes with it, and additional notice is given where the law requires it. If you keep using the App after a change, you accept the changed terms.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. This does not take away any protection that the law of the place where you live gives you as a consumer.
